Condition of Sale Agreement

When you purchase a puppy from me, you are agreeing to my contract whether you sign it or not.

Due to the varying kinds of dog food on the market and the different environmental conditions the puppies come in contact with, we will not guarantee the puppy unless they’re given NuVet Plus daily at the manufacturer’s suggested dosage for 2 years. Failure to do so makes this guarantee null and void. All the information on NuVet is on our website www.aloharanch.net click on the NuVet tab.

The buyer is to keep the pup on NuVet Plus Supplements available by us, the breeder, by using our order code. http://www.nuvet.com/39311 or by calling 800-474-7044 order code # 39311 (Pup must be enrolled in this program within 5 days of purchase to activate this guarantee) 

This puppy has had all immunizations and wormings needed according to veterinarian standards for the age of this puppy, and a medical record will be provided. We will have this puppy veterinarian checked prior to shipping or placing in new home, and the veterinarian will issue a health certificate for all puppies shipped.
The Buyer is responsible for the daily health care and maintenance of the puppy, including all immunizations and examinations recommended after purchase, as well as providing necessary medication and follow-up treatments from veterinarian visits. The Buyer is required to have this puppy examined by a licensed veterinarian within 48 hours of purchase at buyer’s expense. The seller must receive a copy of the Health Certificate regarding the puppy’s exam within 5 days of the purchase of this puppy. The Buyer shall not vaccinate the puppy within the first ten (10) days upon receipt of their puppy. The Breeder will have properly dewormed the puppy up to the departure date, it is the buyer's responsibility to continue proper deworming after receipt. The Buyer understands that intestinal parasites (including hookworms, roundworms, whip worms, coccidia, and giardia) are considered a normal occurrence of all puppies and need regular fecal exams and deworming up to 16 weeks of age or more. Should the examining vet find the puppy to have a LIFE THREATING illness or disease (at the initial exam required within the 48 hour time period) the buyer is entitled to a replacement puppy (not a refund). The buyer must have the puppy examined, appropriate blood work and other lab work ups done (by two different licensed veterinarian's)  to properly diagnose any life threatening illness or disease. The Buyer must then furnish the reports and Health Certificate stating diagnosis of life threatening illness or disease from the two separate licensed veterinarian's for review and verification of life threatening illness or disease by licensed veterinarian of the sellers choice. The buyer may be required to return the puppy at the buyers expense. 
We do not guarantee a puppy that that develops Hypoglycemia or diarrhea due to stress or an improper diet. If a minor condition exists such as worms, ear mites, ect. within 2 weeks of purchase return the dog immediately (at buyers expense) and it will be treated with no additional charge.

Our guarantee does not include poisoning, accidents, negligence or behavioral problems, as training philosophies and environments vary amongst individuals.

In case of death the puppy will have to be sent in by the buyer to a school of veterinary science for a complete necropsy. The findings must be conclusive to reason of death and a complete report sent to breeder's veterinarian of choice for evaluation before a replacement puppy is considered. All expenses incurred are solely the responsibility of the buyer.

This puppy is guaranteed to the buyer, to be free of life-threatening hereditary/genetic disease, until 2 years of age, as long as the puppy is on NuVet Supplements as stated prior in this contract. If the puppy is found to have a life-threatening hereditary/genetic disease, the puppy must be returned at buyer’s expense, before 1 year of age to the seller for replacement puppy (not a cash refund). The buyer must have the puppy examined, appropriate blood work and other lab work ups done (by two different licensed veterinarians) to properly diagnose any hereditary/genetic life threatening disease. The buyer must then furnish the reports and Health Certificate stating diagnosis of life threatening disease from the two licensed veterinarian's for review and verification by licensed veterinarian of the seller’s choice. If in the event the puppy needs to be replaced by conditions set forth by this contract the buyer will receive a puppy (not a cash refund) from the first available litter of the same breed and of the same value as defined by the seller. If the buyer refuses a replacement puppy from the first available litter the buyer forfeit’s the right to a replacement puppy.

In the unlikely event that a dog is suspected of being dysplastic in its first two years, this is the procedure to follow: *Notify us by phone, letter or email *The dog must have been x-rayed for this condition BEFORE its second birthday, but NOT before 1½ yrs. old (sometimes an early x-ray will not portray true results during growth spurts). *Submit the x-ray to the Orthopedic Foundation for Animals, University of Missouri, Columbia, MO 65210 *The dog must never have been used for breeding, not be overweight, and must still be with its original owner. *No replacement will be given if the dog has been over exercised during its growth period (until 1.5 years old), which is running with or “jumping” the dog excessively in play.


If for any reason the buyer needs to place puppy in a new home at any time, the buyer agrees to return the puppy to seller with the understanding that the puppy will be placed in a new home and that buyer will not receive a refund or replacement puppy. If buyer places the puppy in a new home, rescue shelter or humane society ALL guarantees herein are VOID. If the buyer is a breeder or runs a kennel or purchases this puppy for breeding purposes and knowingly holds this information from the seller all guarantees herein are Void. Puppies sold for breeding purposes are subject to price increase at seller’s discrepancies. We require that this puppy be spayed or neutered at 5 to 6 months with proof of the spay/neuter sent to seller. Failure to do so will VOID all of this warranty. The seller assumes no responsibility for the puppy after it leaves possession of seller for adult size, color, conformation, behavior, medical expenses, mortality, family disagreement, or any other reason not pertaining to this contract.

In case any litigation need take place it shall be done in the county and state of the breeder of said puppy. 
This is a binding contract and buyer understands that no other warranty or representation has been made regarding the sale of this puppy. I ACKNOWLEDGE THAT I HAVE READ, UNDERSTAND AND AGREE TO THE CONDITIONS OF THIS SALE.
